Can a Foreigner Own Land in Kenya?
Under Article 65 of the Constitution of Kenya, a person who is not a Kenyan citizen may hold land only on leasehold, for a term not exceeding 99 years. Freehold ownership is reserved for citizens. A company is treated as a citizen only if it is wholly owned by Kenyan citizens.
Options for Non-Citizens and Foreign Companies
- Buy a leasehold interest of up to 99 years.
- Take a lease of commercial or agricultural premises.
- Buy apartments or sectional units held on leasehold.
- Structure investments through a locally registered company, with proper advice on ownership rules.
Kenyan Diaspora Buyers
Kenyan citizens living abroad keep the right to own freehold land. We help the diaspora buy remotely, using powers of attorney, secure payment channels, video execution where possible and site verification by our team.
Buying Safely From Abroad
- Engage an advocate before paying any money.
- Verify title with an official search.
- Pay only through your advocate or a regulated channel.
- Confirm taxes, consents and registration are completed in your name.

Diaspora Buyers and Foreign Buyers Need Different Checks
Living abroad is different from being a non-citizen. Start with the buyer’s citizenship and proposed ownership structure, then confirm the interest the particular title offers. Do not assume forming a Kenyan company removes restrictions connected with its ownership.
Plan Remote Instructions Before Signing
Agree identity verification, document certification, signing arrangements and secure communication with the advocate. If a representative will act under a power of attorney, obtain advice on its scope and the requirements for use in the transaction. Confirm bank details through a previously verified contact.
