Conveyancing Fees in Kenya: Legal Costs for Buying & Selling Property
Understand conveyancing fees in Kenya and budget for legal work, taxes, searches, valuation and registration. Request an itemised estimate from WKA.
How Conveyancing Fees Are Calculated
Advocates’ fees for conveyancing are guided by the Advocates Remuneration Order, which sets scale fees for transactions based on the value of the property. Fees can differ by type of work, such as sale, lease or charge, and the complexity of the matter.
Typical Cost Components
| Cost | Paid by |
|---|---|
| Advocate’s legal fees | Each party pays its own advocate, as agreed |
| Stamp duty | Buyer |
| Capital gains tax | Seller |
| Valuation, search and registration fees | Usually the buyer |
| Land Control Board and rates clearance fees | As agreed in the sale agreement |

This page is general information for readers in Kenya and is not legal advice. Laws, rates and procedures change, so confirm the current position with an advocate before you act.
Ask for an Itemised Estimate
The quote should distinguish professional fees, applicable taxes and third-party expenses. Ask whether it includes agreement review, searches, consent applications, registration follow-up and post-completion checks. A low initial figure is difficult to compare if much of the required work is excluded.
What May Change the Scope
Additional work may arise from a defective title, missing authority, lender requirements, subdivision or an unresolved dispute. Agree how extra instructions will be approved and billed. Government and third-party charges should be supported by the relevant assessment or receipt.
